Terms & Rental Agreement

This agreement outlines the terms of your stay and is designed to ensure a seamless and respectful experience for all parties.

Reservation & Payment

A reservation is confirmed upon receipt of a 50% deposit.
The remaining balance will be automatically charged 30 days prior to arrival.

Reservations made within 30 days of arrival require full payment at the time of booking.

All payments are securely processed via encrypted third-party payment systems.

Taxes

Hawaii State General Excise Tax (GET), Transient Accommodations Tax (TAT), and Kauai Transient Accommodations Tax (KTAT) are additional and will be applied to your booking total.

Cancellations

Cancellations made within 48 hours of booking are fully refundable.

After 48 hours:

• The initial deposit is non-refundable
• No refunds are issued within 30 days of arrival

We strongly recommend purchasing travel insurance to protect against unforeseen changes.

Check-In & Check-Out

Check-in and check-out times are provided prior to arrival.
Early check-in or late check-out may be available upon request but cannot be guaranteed.

Occupancy & Use

The number of guests must not exceed the number confirmed at booking.

The property is intended for quiet enjoyment and personal use only.
Events, parties, or commercial use are not permitted without prior written approval.

Care of Property

Guests agree to treat the home with care and respect.

Any damage beyond normal wear and tear may result in additional charges.

Safety & Assumption of Risk

Kauai is a place of extraordinary natural beauty, with inherent environmental variability.

Guests acknowledge and accept responsibility for:

• Ocean conditions (including currents, surf, and lack of lifeguards in some areas)
• Weather-related changes (including rain, flooding, or access limitations)
• Natural terrain and surroundings

By confirming this reservation, guests voluntarily assume all risks associated with their stay.

Limitation of Liability

The property owner is not liable for:

• Personal injury
• Loss or damage to personal belongings
• Travel disruptions, weather events, or circumstances beyond reasonable control
